Right of Withdrawal Notice

Consumers generally have a statutory right of withdrawal of fourteen (14) days for distance contracts.

Expiry of the Right of Withdrawal for Digital Content

In the case of contracts for the supply of digital content not delivered on a tangible medium (e.g. trading indicators), the right of withdrawal expires in accordance with Section 356 (5) of the German Civil Code (BGB) if

  • the customer has expressly agreed that the Company begins performance of the contract (activation of the indicator) before the expiry of the withdrawal period, and

  • the customer has confirmed their knowledge that, by giving such consent, they lose their right of withdrawal.

The contract is concluded only if this consent is actively given during the checkout process by means of a separate checkbox in the shopping cart.

Right of Withdrawal for Subscription Contracts

For subscriptions for digital content, the statutory right of withdrawal of fourteen (14) days from the date of contract conclusion applies in principle.

The right of withdrawal also expires for subscription contracts if the customer

  • expressly agrees to the immediate commencement of contract performance, and

  • confirms that they acknowledge the loss of the right of withdrawal as a result of this consent.

In this case, access to the digital content is granted immediately after the contract is concluded.
